City Cover Letter for 2009 Council E-mails

This file contains the one-page cover letter that the City of Austin Public Information Office provided in response to The Austin Bulldog’s open records request of May 1, 2011, for e-mails that the mayor, council members, and city manager sent to, or received from, each other in 2009. Although the Texas Attorney General has issued at least four open records opinions which state that e-mails about government business that were created or received on personal accounts are public records—and thus subject to release under the Texas Public Information Act—this cover letter, once again, claims that those council members who forwarded e-mails from their personal accounts to the city server did so voluntarily.
