Harper Park Two LP, Appellant, v. City of Austin et al (No. 03-10-00506-CV)

This 10-page PDF contains the record of the decision of the Third Court of Appeals, which reversed the trial court’s decision and allowed the development of a six-acre lot in Harper Park Two to proceed with vested rights under the Barton Creek Watershed ordinances. Although the City of Austin appealed the Third Court’s decision to the Texas Supreme Court, the higher court declined to take up the case and the decision stood. Environmental attorneys claim this decision made it easier for other developments to proceed under older, less restrictive ordinances.
