Marc A. Ott v. Zadie Jackson, et al

Marc Ott left his job as city manager of Kalamazoo, Michigan, in January 1997, after he and the city’s mayor signed a separation agreement on January 27, 1997, that terminated his employment. The agreement bound the city commissioners “not to do or say anything that disparages Marc A. Ott, or portrays Marc A. Ott in a negative light.” The lawsuit, filed in the Circuit Court of the County of Kalamazoo in July 1998, alleged that the city breached the separation agreement. The city caused the lawsuit to be moved to the U.S. District Court for the Western District of Michigan. In June 1999 the federal court granted defendants’ motion for summary judgment on two counts and dismissed the remaining three counts.
